Welcome to YemPac World Express (“YemPac”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website yempacworldexpress.com, mobile applications, APIs, and all shipping, freight, logistics, courier, warehousing, and related services (collectively, the “Services”). By creating an account, booking a shipment, or using our Services, you agree to these Terms.

Please read carefully: These Terms include limitations of liability, customs responsibilities, and dispute resolution provisions that affect your rights. If you do not agree, do not use our Services.

1. Our Services

YemPac provides domestic and international shipping solutions including express courier, air freight, ocean freight, road transport, last-mile delivery, fulfillment, and customs brokerage coordination. We act as a logistics intermediary and carrier. Actual carriage may be performed by YemPac or by third-party carriers, airlines, and partners under their own conditions.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.

2. Eligibility & Accounts

  • You must be at least 18 years old and capable of entering a binding contract.
  • You agree to provide accurate, complete information and keep it updated.
  • You are responsible for all activity under your account, including API keys and passwords. Notify us immediately of unauthorized use.
  • Business accounts: You represent you have authority to bind the company.

3. Quotes, Bookings & Rates

  • Quotes are based on information you provide (weight, dimensions, origin, destination, contents). We use dimensional weight: Chargeable Weight = max(Actual Weight, (L x W x H / 5000)) for air express.
  • Final charges may vary due to re-weigh, dimensional check, fuel surcharge, remote area surcharge, customs duties/taxes, or storage.
  • You must ensure shipment details are accurate. Mis-declaration may result in additional fees, return, or seizure.
  • We may cancel or refuse any booking suspected of fraud, sanction violation, or prohibited content.

4. Your Responsibilities as Shipper

You agree to:

  1. Properly pack shipments to withstand transport, label correctly, and provide complete sender/recipient details.
  2. Provide accurate commercial invoice, HS codes, and required export/import licenses.
  3. Not ship Prohibited Items (see Section 5).
  4. Comply with all applicable laws, including export controls, sanctions (UN, US OFAC, EU, UK), and anti-money laundering rules.
  5. Pay all charges, including duties/taxes if you select DDP or if recipient refuses to pay under DAP.

5. Prohibited & Restricted Items

You may NOT ship: Explosives, firearms, ammunition, illegal drugs, counterfeit goods, live animals, human remains, perishables without approval, cash, bearer instruments, hazardous materials (unless pre-approved DG shipment), pornographic material prohibited by law, or any item banned by origin/destination country or carrier.

Restricted items requiring pre-approval: Lithium batteries (UN3480/3481), alcohol, tobacco, pharmaceuticals, cosmetics with alcohol, high-value electronics > $5,000. Contact support@yempacworldexpress.com for approval. We may inspect shipments as permitted by law. Non-compliance may lead to fines, destruction, and legal liability borne by you.

6. Customs, Duties & Taxes

  • International shipments are subject to customs inspection and duties/taxes determined by destination authorities.
  • DAP (Delivered At Place): Recipient pays duties/taxes. DDP (Delivered Duty Paid): You pay. If recipient refuses DAP charges, they revert to you plus handling fees.
  • You authorize YemPac and its brokers to act as your agent for customs clearance and to complete declarations on your behalf.
  • Delays due to customs, regulatory holds, or incorrect documentation are not YemPac’s liability.

7. Payments & Fees

Storage / Demurrage After 3 days free storage, $5/day per 10kg or carrier rates

Payments are processed via Stripe, PayPal, or bank transfer. Late payments incur 1.5% per month. You authorize us to charge your on-file method for adjustments, duties, or return fees with invoice notice.

8. Pickup, Transit & Delivery

  • Estimated transit times are estimates, not guarantees, unless you purchase a guaranteed service with written confirmation.
  • Delivery requires signature unless you authorize no-signature release. Proof of delivery (POD) will be provided electronically.
  • If recipient is unavailable, we will attempt 2 additional deliveries. After that, shipment may be returned at your cost or held for pickup.
  • You must report non-delivery within 7 days of expected delivery date.

9. Insurance & Liability

A. Declared Value & Insurance

Basic liability coverage is limited. We strongly recommend purchasing additional insurance at checkout. Declared value is not insurance unless you purchase and pay for insurance.

B. Liability Limits

Domestic: Up to $100 or actual value, whichever is lower, unless higher declared value insured.
International Express (Montreal/Warsaw Convention): Limited to 22 SDR per kg (~$30/kg).
Ocean Freight: $500 per package under Hague-Visby unless higher value declared.
Maximum liability for any shipment shall not exceed $1,000 unless you purchase additional coverage.

We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profit, market, or goodwill, even if advised of possibility.

10. Claims for Loss or Damage

  • Visible damage must be noted at delivery and reported within 48 hours with photos of packaging and goods.
  • Concealed damage/loss must be reported within 7 days.
  • Claims must include AWB, invoice, photos, and value proof. We will process within 30 days.
  • Failure to report within time limits waives claim. No claim for shipments with inadequate packaging or prohibited items.

11. Prohibited Conduct

You agree not to: use Services for illegal purposes, upload malware, attempt to hack, scrape rates without permission, create fake tracking, or interfere with operations.

12. Intellectual Property

All content on our site, including logos, text, tracking technology, and software, is owned by YemPac or licensors. You are granted a limited, non-transferable license to use our platform for shipping purposes only. You may not copy, reverse-engineer, or resell our technology.

13. Termination

We may suspend or terminate your account for breach, fraud, non-payment, or abuse. You may close your account anytime, but remain liable for pending shipments and fees. Sections 6-18 survive termination.

14. Disclaimers

Services are provided “as is” and “as available”. We disclaim warranties of merchantability, fitness for purpose, and non-infringement to the fullest extent permitted by law. We do not warrant uninterrupted or error-free service.

15. Limitation of Liability

To the maximum extent permitted by law, YemPac’s aggregate liability for all claims arising from Services in any 12-month period shall not exceed the total fees you paid to YemPac in the 3 months preceding the claim.

16. Indemnification

You agree to indemnify and hold harmless YemPac, its officers, employees, and partners from claims, damages, fines, and costs (including attorney fees) arising from your shipments, mis-declaration, breach of Terms, or violation of law.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of all countries. Any dispute shall first be attempted to be resolved via mediation within 30 days by contacting legal@yempacworldexpress.com. If unresolved, disputes shall be submitted to arbitration under any Court of Arbitration (LCA) Rules. For customers in the EU/UK, you retain mandatory consumer protection rights. For US customers, arbitration under AAA rules applies if you opt-in.

18. Changes to Terms

We may update Terms periodically. We will post the updated version with new effective date and notify material changes via email or dashboard notice. Continued use after update constitutes acceptance.
